LEGAL ISSUES CONCERNING THE PREVENTION AND SUPPRESSION OF TORTURE AND ENFORCED ACT B.E. 2565 (2023)

Abstract
The main purpose of this research is to conduct studies and analysis of the Prevention and Suppression of Torture and Enforced Disappearance Act B.E. 2565 (2023). The qualitative research will be conducted based on literature review, comparative studies of international laws, law of the Republic of the Philippines, the Federal Democratic Republic of Nepal, and the United Mexican States, in comparison with Thai laws.
The outcome of the research shows that there are issues concerning the Prevention and Suppression of Torture and Enforced Disappearance Act B.E. 2565 (2023) including issues concerning the definition of the act of torture, the cruel, inhuman, and degrading treatment or punishment and enforced disappearance, the power of investigation, the amnesty law, as well as physical and mental checkups.
Based on the research, it is recommended that the definition of physical or emotional torture is added, and that the provisions on the investigative power, amnesty, as well as physical and mental checkups are added in the Prevention and Suppression of Torture and Enforced Disappearance Act B.E. 2565 (2023).
