บทคัดย่อ
งานวิจัยนี้มีวัตถุประสงค์หลัก เพื่อศึกษาและวิเคราะห์ปัญหาพระราชบัญญัติป้องกันและปราบปรามการทรมานและการกระทำให้บุคคลสูญหาย พ.ศ. 2565 โดยการวิจัยเชิงคุณภาพ ด้วยการวิจัยเอกสาร ศึกษากฎหมายระหว่างประเทศ กฎหมายสาธารณรัฐฟิลิปปินส์ สหพันธ์สาธารณรัฐประชาธิปไตยเนปาล และสหรัฐเม็กซิโก เปรียบเทียบกับกฎหมายไทย
ผลการวิจัยพบว่าพระราชบัญญัติป้องกันและปราบปรามการทรมานและการกระทำให้บุคคลสูญหาย พ.ศ. 2565 มีปัญหาในประเด็นดังนี้ คือ ปัญหาเกี่ยวกับบทนิยามการกระทำความผิดฐานกระทำทรมาน การประติบัติหรือการลงโทษที่โหดร้ายไร้มนุษยธรรม หรือที่ย่ำยีศักดิ์ศรี และกระทำให้สูญหาย ปัญหาเกี่ยวกับอำนาจสอบสวน ปัญหาเกี่ยวกับการนิรโทษกรรม และปัญหาเกี่ยวกับการตรวจร่างกายและจิตใจ
ข้อเสนอแนะงานวิจัยให้มีการเพิ่มบทนิยามการทรมานทางร่างกายและจิตใจ แก้ไขบทบัญญัติเรื่องอำนาจสอบสวน เพิ่มบทบัญญัติเรื่องนิรโทษกรรม และเพิ่มบทบัญญัติเกี่ยวกับการตรวจร่างกายและจิตใจในพระราชบัญญัติป้องกันและปราบปรามการทรมานและการกระทำให้บุคคลสูญหาย พ.ศ. 2565
