The Development of a Legal System Related to Tourism

Abstract
This research article aims to examines the legal problems related to tourism in Thailand, compares the laws related to tourism in Thailand and the laws related to tourism abroad and constructs legal measures in the development of a legal system related to tourism. The researcher employed a qualitative research approach, utilizing data collection methods including documentary research, in-depth interviews with 45 participants, and focus group discussions with 10 participants. The data were analyzed using content analysis and comparative analysis techniques.
Findings are as follows: The development of the legal system related to tourism poses problems in the following matters. The authority and duties of the Tourism Business and Guide Committee pose problems in the proposal of opinions to the minister for the consideration of an issuance of regulations and measures. The measures to control tourism business operators and guides for damages from tourist complainants. The complaints that are received are from the fact that tourism business operators and guides do not perform in accordance with the agreement or advertisements or persuasion. The duration for suspending a license for a tourism business and guides. Consideration of appeals and adjudication of orders of the registrar. Therefore, The committee should be designated to have the authority and duties in proposing opinions to the minister specifically. Government agencies should be authorized for making loans. Caretakers should be specifically appointed in the characteristics of probation. The period of time for license suspension should be increased per time. The registrar should have the authority to consider license suspension specifically in a continuous manner. The committee should be able to use discretion in the consideration of appeals to the registrar’s orders to issue orders differently.
