Abstract

The purpose of this thesis was to study laws relevant to film rating under the Film and Video Act, B.E. 2551, particularly the film rating on movie ban and film rating to discover whether the present laws on film rating in Thailand associated with the changing society. Also, the research examined and analyzed film ratings in foreign countries including the United States of America, Australia and England. The findings indicated that the enforcement of the Film and Video Act, B.E. 2551 has changed the film control from censorship system to film ratings regarding to suitable age of audiences which beneficial to protect children and youth. However, the legal problems and obstacles on enforcement in term of theory and practice have been found for 8 years since the enforcement. The major issues were defects of laws on film rating and authority of the film and video rating committee. For example, problems on film rating under the Section 26 of the Act, the conflict authority given under the Section 26(7) and Section 29, rating problems on film trailers, and proportion and discretion of the film and video rating committee were found. Regarding to the mentioned problems and obstacles, the author recommends to amend or improve legal measures associated with objectives of film rating by amending Section 16 and Section 26 of the Film and Video Act, B.E. 2551. As well as, add the provision formed as a part of clause 1 under the Ministerial Regulations on Film Types Determination, B.E. 2552 for the purpose of enforcing laws on film rating is more efficient.
