Abstract

This academic article presents the concept of disappearance. It was found that it is a concept that arises from the performance of government officials who have tortured or committed cruelty and made persons disappear to the victims or tortured persons in a manner that violates the basic human rights of the general public. The essence of the Prevention and Suppression of Torture and Disappearance Act of 2022 found that there are 3 offenses as follows: 1) Offenses of committing torture 2) Offenses of committing cruel, inhumane, or degrading acts. being a human being and 3) the crime of causing the disappearance of a person Problems and obstacles in the disappearance of government officials were found to be 1) caused by setting penalty rates that are inappropriate for the offense for government officials. 2) caused by a lack of immunization for the people to be aware of the importance of human rights. 3 ) caused by the delay in rehabilitating victims of beatings and returning them to their original state, both physically and mentally, and 4) caused by the lack of creation of public sector networks to be organizations that monitor the performance of government officials. From the stage of arrest and detention as well as the investigative officer level in a parallel manner with the organization.
