บทคัดย่อ
ธรรมาภิบาลกับการใช้ดุลพินิจของ อ.ก.ค.ศ. เขตพื้นที่การศึกษาในการโอนย้ายข้าราชการครูและบุคลากรทางการศึกษา มีวัตถุประสงค์เพื่อ (1) ศึกษากฎหมายวิธีปฏิบัติราชการทางปกครองและกฎหมายว่าด้วยระเบียบข้าราชการครูและบุคลากรทางการศึกษา (2) ศึกษารูปแบบและขั้นตอนการโอนย้าย และ (3) เสนอแนวทางแก้ไขปัญหาความเป็นกลางในการใช้ดุลพินิจตามหลักธรรมาภิบาล เป็นการศึกษาแบบเชิงคุณภาพ โดยใช้ข้อมูลจากเอกสารและการสัมภาษณ์เชิงลึกผู้ทรงคุณวุฒิ เจ้าหน้าที่ และผู้มีส่วนได้ส่วนเสีย ผลการศึกษา พบว่า การใช้อำนาจด้านการบรรจุ แต่งตั้ง โอน ย้าย และเลื่อนตำแหน่ง ต้องอยู่ภายใต้กฎหมายและใช้ดุลพินิจอย่างเหมาะสม การพิจารณาโอนย้ายใช้ระบบคณะกรรมการกลั่นกรองจากหลายหน่วยงาน มีขั้นตอนชัดเจนตั้งแต่กำหนดตำแหน่งว่าง รับคำร้อง ตรวจสอบคุณสมบัติ ประเมินตามเกณฑ์ และเสนออนุมัติ ทั้งนี้การแก้ปัญหาความไม่เป็นกลางจำเป็นต้องมีระบบที่โปร่งใส ตรวจสอบได้ มีหลักเกณฑ์แน่นอน และยึดหลักธรรมาภิบาล เพื่อเสริมสร้างความเป็นธรรมและความเชื่อมั่นต่อระบบบริหารงานบุคคลภาครัฐ ข้อเสนอแนะที่ได้จากการศึกษา คือ ให้หน่วยงานที่เกี่ยวข้องกำหนดหลักเกณฑ์การใช้ดุลพินิจให้ชัดเจน โปร่งใส ส่งเสริมความรู้ด้านธรรมาภิบาลแก่คณะกรรมการ และพัฒนาระบบการให้เหตุผลและตรวจสอบคำสั่งทางปกครอง เพื่อป้องกันข้อพิพาทและสร้างความเป็นธรรมในการโอนย้าย
