Legal Obstacles to Cannabis Trading in Thailand

Abstract

The purpose of this research was 1) to study the background, concepts, theories, and rules concerning international narcotics laws, including the system of marijuana and hemp trade markets, 2) to compare and analyze legal rules concerning the trading of Cannabis, whether narcotics laws or related laws other than narcotics laws in Thailand with Cannabis Act of Canada and Colorado Constitution section 14 and 16 of the state of Colorado, U.S.A. and 3) to propose suitable legal solutions for marijuana and hemp trade (Cannabis) in Thailand. This research was qualitative research from the following documents; books, articles, and information from electronic media whether in Thailand or abroad. The result of this research was found that Thailand should be amended the Cannabis rules in Narcotics law and other related laws that still conflict with the definition of marijuana and hemp. It was also a monopoly of Cannabis business license for only government agencies. In addition, the relevant laws do not support Cannabis trade, whether Cannabis tracking system, Cannabis standard, Label Mark in Cannabis product, Cannabis tariffs, including trademarks for Cannabis entrepreneurs.
