Analysis on the Management of Copyright Collective Management Organizations

Abstract

The purposes of this research were (1) to study the background and concept of collective management and the Collective Management Organizations (CMOs); (2) to study the various kinds of CMOs and their functions and appropriate legal measures regarding the collective management of copyright according to foreign law; and (3) to propose the appropriate guidelines for the collective management which is undertaken by the CMOs and the proper law applicable to the royalty collection. This was a documentary research by analyzing and synthesizing related literature demonstrated that there were several models of collective management of copyright undertaken by the Collective Management Organization (CMO) depend on copyright works. The CMOs are established in many countries in order to administer rights of the copyright owners and have their own law supporting establishment of the CMO. In Thailand, there has been a problem establishing the CMO since there is no law supporting establishment of the CMO. It was recommended that Thailand should set up a proper CMO and sui generis legislation for the royalty collection should be enacted.
