Protection of Geographical Indications in the Case of Migration of People in the Community

Abstract

Geographical Indication is a type of intellectual property intended to protect community rights. But at present, the rules prohibit the use of the word “kind”, “type”, “style” or similar words with only four types of goods, namely rice, silk, wine, and spirits. As a result, there may be an impact on community rights from the use of such annotation in the case migration of people in the community regarding confusion and misunderstandings in the source and quality of the product. And when the researcher studied international law and foreign law on the protection of geographical indications, it was found that there were different criteria for protection according to the protection objectives. Therefore, if the appropriate criteria are applied to amend the law that protects geographical indications of Thailand. It will protect the rights of communities from the use of the word “kind”, “type”, “style” or similar words or elements in conjunction with geographical indications. In the case of migration of people in the community more comprehensive, clear, and effective.
