A New Approach to Determine the Age of Emancipation in the Modern Era

Abstract
The purpose of this research aimed to study a new approach to determine the age of emancipation in the modern era. Preparedness to support the replacement of elderly workers and determining the rights and duties of individuals including considering Thai and foreign laws in determining the age of a person to be appropriate in determining the age of maturity of a person are the key issues leading to propose the revision of the Civil and Commercial Code. The research methodology included qualitative research, document research, in-depth interviews with 10 people and focus group discussions with 20 people. The findings showed that a combination of factors such as the economy, political system, society, governance, education, labour market, information technology, and the outbreak of the coronavirus (COVID-19) has resulted in the changing of people lifestyles. Entering an aging society and growing to age of maturity are important factors leading to the development of human resources in the changing situation. According to Thai Law, The Civil and Commercial Code states that ‘A person, on completion of twenty years of age ceases to be a minor and becomes sui juris’, whereas, a person on completion of eighteen years of age has the right to vote, work in government service, and able to have a driving license. It appeared from the study that many civilized countries have revised their laws in reducing the age of an individual to be the maturity at eighteen due to the rapid change of economic and social context. It was suggested that the age of maturity in Thai Law should be reduced to eighteen years of age in order to increase the rights and duties of individuals and prepare to support the replacement of elderly workers in Thailand.
