Protection of Land Rights of the Sea Gypsy Ethnic Groups through the Process of Declaration Cultural Protected Areas

Abstract

This research article is part of a study on legal measures for protecting the land rights of indigenous ethnic communities: a case study of Thap Tawan Village, Takua Pa District, Phang Nga Province. The objective is to examine the process and steps involved in declaring culturally protected areas and to provide guidance for improving policies or laws that align with the enforcement of land rights protection for indigenous ethnic communities. The study adopts an action research approach. The research results show that the government has expedited the survey to issue title deeds. If there is a dispute, it will comply with legal process. Additionally, the Sea Gypsy ethnic groups shall enter into legal proceedings and must accept the arising disputes. At present, the aforementioned ethnic groups are still threatened and evicted from the disputed area. It creates terror in their lives and stability in their housing. In addition, neither the legislative process nor the mechanism for the protection of ethnic land rights have a compulsory mechanism. Therefore, it is necessary to declare a culturally protected area as a guideline for the way of life of the ethnic group’s revitalization in accordance with the cabinet resolution on the Sea Gypsy ethnic group in order to ensure housing security and strengthen the community in the future.
