PROBLEMS OF USING THE POWER OF SENATORS: THE STUDY OF THE SITUATION OF USING THE FIRST SELECTION POWER UNDER THE TRANSITIONAL PROVISIONS OF THE CONSTITUTION OF THE KINGDOM OF THAILAND BE 2017

Abstract

This research aims to study the principle, concepts and theories related to the roles and duties of senators in the foreign and Thai constitution As well as studying the problem of using the powers of senators in collaboration with members of the House of Representatives In choosing a prime minister According to the Constitutional Provisions of the Kingdom of Thailand 2017 to be a guideline for solving problems in exercising powers of senators. The results of the research were: the power exercise of the senators of the Constitution of the Kingdom of Thailand 2017 is not consistent with Roles and powers of senators in the foreign constitution and the past constitution of Thailand. It was inconsistent with the principles, concepts and theories and causes problems in the post-election system of parliament. In addition, it was found that the use of powers of senators to work with members of the House of Representatives to elect the Prime Minister. It destroys the political party system that is inconsistent with the theory of institutionalization of political parties.

Suggestion : in the 2017 Constitution of the Kingdom of Thailand, it is extremely expedient that amendments are required that only members of the House of Representatives, who have passed through the people's election mechanism and the political party system, have the power to elect the prime minister.
