PROBLEMS OF MEMBERS OF THE HOUSE OF REPRESENTATIVES NOT FOLLOWING POLITICAL PARTY RESOLUTIONS CASE STUDY ACCORDING TO THE CONSTITUTION OF THE KINGDOM OF THAILAND BE 2017

Abstract
The purposes of the study were to investigate the problems of non-compliance of members of the House of Representative with political party resolutions, a case study under the Constitution of the Kingdom of Thailand, BE 2560, which was the comparative study between the principles of guaranteeing the independence of members of parliament in foreign countries and Thailand and the political principles and theoretical concepts, and to explore the solutions to the problems. The results showed that 1) The legal principles of England and Germany, like those in Thailand, recognize the independence of members of parliament in the performance of their duties, However, in practice, these legal frameworks primarily ensure independence by defining the legal status of parliamentary members. In contrast, members of the House of Representatives often invoke this constitutional independence under the Constitution of the Kingdom of Thailand BE 2560 to justify non-compliance with their political party’s resolutions. 2) The non-compliance of members of the House of Representatives with political party resolutions may lead to several problems. First, the problems related to a theoretical inconsistency with the principles and theories related to political parties and a deviation from the principles and theories of constitutionalism, Second, the practical problems hindering the operation of the parliamentary system and government causing the government instability and undermining the political party system, which should be addressed to amend the constitution to require members of the House of Representatives to comply with the resolutions of their respective political parties.
