Abstract

The Plain Packaging Policy within the Australian Tobacco Industry is one of the most interesting public health policies in this era.  The conflict between public interest for public health and safety against protected rights of foreign investor is at stake.  This legal battle is seemingly apparent on both the domestic court and international level. As such, this serves as a relevant basis for comparison with the study of the alcohol beverages industry which may offer great point of reference to Thailand’s problem with regards to the preventive measures to control alcoholic consumption.  

This article draws close attention to the legal aspect of this issue especially on measures taken by the Australian government such as packaging restrictions, health warning etc. In addition, the legal procedures, judgments of the High Court of Australia and the international dispute settlement mechanisms under ISDS (Investor State Dispute Settlement) and WTO are being studied and examined.  Thailand recently attempted to have certain stricter control on packaging, media and advertisement, which may lead to certain legal obligations upon the alcohol industry in the near future. Thai scholars especially in the legal and public health fields shall therefore need to prepare for the challenges brought about by foreign investors, with understanding and careful deliberation.
