ตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 กำหนดให้สิทธิในน้ำเป็นสิทธิขั้นพื้นฐานของ ประชาชน และขณะนี้ประเทศไทยอยู่ระหว่างการยกร่างพระราชบัญญัติทรัพยากรน้ำ พ.ศ... โดยกฎหมายฉบับนี้ จำเป็นต้องสอดคล้องกับพันธกรณีในกติการะหว่างประเทศว่าด้วยสิทธิทางเศรษฐกิจ สังคม และวัฒนธรรม ค.ศ. 1966 และกฎหมายฉบับนี้ยังควรรองรับการแก้ปัญหาคุณภาพน้ำ รวมทั้งการแก้ปัญหากฎหมาย จารีตประเพณีที่ขัดกับกฎหมายบ้านเมือง ซึ่งประเทศไทยสามารถนำประสบการณ์การใช้กฎหมายน้ำของ ประเทศอินเดียร่วมกับคำพิพากษาศาลสูงอินเดียมาใช้ เพื่อให้พระราชบัญญัติทรัพยากรน้ำ พ.ศ... ที่จะ เกิดขึ้นมีประสิทธิภาพและสอดคล้องกับพฤติกรรมการใช้น้ำของชาวไทย
