The problem of the issuing the land certificate of title that cause public land: Citizen sharing type is enclosed

Abstract

Regarding the problem of issuing the land certificate of title that cause public land: Citizen sharing type is enclosed, there were the absence of laws which regulate in effect to such problem. In addition, the laws would not allow a land officer to use their discretion to give any orders to leave a way for passing through from the land used in common by public to other land used.

          Thai law does not support for this problem, however, foreign law is legally effective. In case that the land certificate of title has already issued, the land expropriation decree has to be used for resolution as the corrective action. For the case where the land certificate of title is being considered to be issued, there would not be any authorized issuing for a certificate until the land owner agree to leave a way for passing through and until the compensation has been received by the land owner.
