Legal Problems About Legal Status of Thai Asset Management Corporation

Abstract
The purposes of this research were: 1) to study comparative study rules for establishing a British corporation, Rules for establishing a corporation in France and criteria for establishing a corporation in Thailand; 2) to analyze problems that may arise from the fact that the law does not prescribe that the Thai Asset Management Corporation have a clear legal status; and 3) to propose solutions and find appropriate solutions to the problems encountered in order for the Thai Asset Management Corporation to have a clear legal status from the study of the law. In this research, qualitative research was conducted through documentary research. It was found that Thai Asset Management Corporation is a juristic person, which is a government agency but not an official part or state enterprise under the budget law and other laws. The result was as follows: the Thai Asset Management Corporation is a state enterprise in the category of financial institutions, which is different from British and French law. Resulting in legal consequences as a result is flexibility and flexibility in management like a general private company.
