Development Approach of Justice for People by the Public Defender

Abstract

This research aimed to 1) study the systematic pattern of public defenders in other countries that have an international standard; 2) find out problems and obstacles in using the system of public defenders in Thailand; and 3) seek any pattern and model development of public defenders suitable for Thai society. This research reviewed documents, conducted in-depth interviews, and formed a focus group. Research procedures were guaranteed by human research ethics. The results showed that United States of America employed public defender system because it extremely attended in suspect’s right issue considered as a fundamental right and a guarantee in litigation. In England, suspects were considered disadvantageous because they had no legal knowledge and were also scared, confused, or induced. So, having an attorney helped people’ benefits. Philippines had a Public Defender Bureau for finding attorneys for poor people in litigation. After analyzing the foreign patterns, problems, and obstacles in using the system of public defenders in Thailand, a researcher found a model development of the public defender system. This really helped people in equally approaching the fairness.
