บทคัดย่อ
บทวิเคราะห์นี้มีวัตถุประสงค์เพื่อศึกษาปัญหาการใช้ประโยชน์ที่ดินตามกฎกระทรวงให้ใช้บังคับผังเมืองรวม และการวางและจัดทำผังเมืองตามโครงสร้างตามเจตนารมณ์ของพระราชบัญญัติการผังเมือง พ.ศ. 2518 รวมทั้งการแก้ไขเพิ่มเติมพระราชบัญญัติผังเมืองฉบับต่าง ๆ วิเคราะห์ปัญหาทางกฎหมายที่ส่งผลกระทบต่อประชาชนที่ต้องปฏิบัติตามผังเมือง ใช้การศึกษาจากเอกสาร รวมทั้งกฎหมายผังเมืองของต่างประเทศที่ประเทศไทยได้รับแนวคิดมา พบว่ามีปัญหาด้านกฎหมาย 2 ประการคือ (1) การใช้ประโยชน์ที่ดินตามผังเมืองรวม ตามมาตรา 26 ประกอบมาตรา 26/1 แห่งพระราชบัญญัติการผังเมือง พ.ศ. 2518 และ (2) การใช้ประโยชน์ที่ดินตามผังเมืองรวมที่ไม่เป็นไปตามโครงสร้างของพระราชบัญญัติการผังเมือง พ.ศ. 2518 ส่งผลให้การวางและจัดทำผังเมืองไม่บรรลุตามเจตนารมณ์ของกฎหมายผังเมืองที่แท้จริง
