บทคัดย่อ
ปัญหาการเข้าร่วมของสหวิชาชีพในกระบวนการยุติธรรมทางอาญาสำหรับเด็กและเยาวชน พบว่าในการสอบปากคำเด็กและเยาวชนที่กระทำความผิด มีข้อยกเว้นให้พนักงานสอบสวนทำการสอบปากคำได้ ปัญหาการมีส่วนร่วมของสหวิชาชีพในการสืบเสาะข้อเท็จจริง ควรให้สหวิชาชีพมีส่วนร่วมในการสืบเสาะข้อเท็จจริง เพราะทำให้ได้ข้อเท็จจริงที่หลากหลายและหลายมุมมอง ผลการวิจัยพบว่า การวิจัยเปรียบเทียบกฎหมายไทยกับกฎหมายต่างประเทศมีบางประเทศที่มีหน่วยงานหรือองค์กรต่าง ๆ เข้าร่วมในกระบวนการยุติธรรมทางอาญาสำหรับเด็กและเยาวชน แต่ไม่ได้เรียกว่าสหวิชาชีพ ดังนั้น การศึกษาเอกสาร การสัมภาษณ์ และการระดมสมองจากผู้เชี่ยวชาญ ทำให้ได้แนวทางในการแก้ไขกฎหมาย โดยเห็นควรให้สหวิชาชีพเข้าร่วมในการสอบปากคำเด็กและเยาวชนที่กระทำความผิดทุกกรณี โดยไม่มีข้อยกเว้น และเข้าร่วมในการสืบเสาะข้อเท็จจริงด้วย
