บทคัดย่อ
การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อทำการศึกษาปัญหาการทำประมงผิดกฎหมาย ขาดการรายงาน และไร้การควบคุม ศึกษาหลักการแห่งความตกลงว่าด้วยมาตรการของรัฐเจ้าของท่า เพื่อป้องกัน ยับยั้ง และขจัดการทำประมงที่ผิดกฎหมาย ขาดการรายงาน และไร้การควบคุม และวิเคราะห์ความสอดคล้องระหว่างมาตรการและหลักการของความตกลงว่าด้วยมาตรการของรัฐเจ้าของท่า เพื่อป้องกัน ยับยั้ง และขจัดการทำประมงที่ผิดกฎหมาย ขาดการรายงาน และไร้การควบคุม กับนโยบาย และมาตรการทางกฎหมายของประเทศไทย ซึ่งประเทศไทยในฐานะสมาชิกขององค์การอาหารและเกษตรแห่งสหประชาชาติ ได้ยื่นภาคยานุวัติสารเพื่อเข้าเป็นภาคีความตกลงฯ แล้ว เมื่อวันที่ 6 พฤษภาคม 2559 ประเทศไทย จึงมีพันธกรณีที่จะต้องปฏิบัติตามความตกลงดังกล่าวอย่างเคร่งครัด จึงมีความจำเป็นต้องมีการแก้ไขเพิ่มเติมกฎหมายว่าด้วยการประมง ให้สอดคล้องและครอบคลุมพันธกรณีของความตกลงฯ อย่างครบถ้วน จากการศึกษาพบว่า ประเทศไทยยังดำเนินการปรับปรุงแก้ไขกฎหมายว่าด้วยการประมงไม่ครบถ้วน และครอบคลุมพันธกรณีของความตกลง โดยเฉพาะมาตรการด้านการส่งเสริม และความร่วมมือระหว่างประเทศในการแก้ไขปัญหาการทำประมงที่ผิดกฎหมาย
