การคุ้มครองสิทธิเกษตรกรในระบบเกษตรพันธสัญญา

บทคัดย่อ
ปัจจุบันแม้เกษตรกรในระบบเกษตรพันธสัญญาในประเทศไทย จะได้รับการคุ้มครองตามพระราชบัญญัติส่งเสริมและพัฒนาระบบเกษตรพันธสัญญา พ.ศ. 2560 แต่กฎหมายดังกล่าวยังไม่สามารถคุ้มครองสิทธิของเกษตรกรได้ครอบคลุมการทำสัญญาในระบบเกษตรพันธสัญญาทุกประเภท เนื่องจากมีปัญหาเกี่ยวกับการกำหนดจำนวนคู่สัญญาฝ่ายเกษตรกรในสัญญาการผลิตผลิตผลทางการเกษตร ปัญหาการหลีกเลี่ยงพระราชบัญญัติส่งเสริมและพัฒนาระบบเกษตรพันธสัญญาฯ และปัญหาการจัดหาเงินทุนของเกษตรกร บทความนี้จึงขอนำเสนอแนวทางแก้ไขปัญหาดังกล่าวโดยการแก้ไขเพิ่มเติมพระราชบัญญัติส่งเสริมและพัฒนาระบบเกษตรพันธสัญญาฯเกี่ยวกับจำนวนคู่สัญญาฝ่ายเกษตรกร การส่งเสริมให้ผู้ประกอบธุรกิจทางการเกษตรเข้าสู่ระบบกฎหมายเกษตรพันธสัญญา และการอำนวยความสะดวกในการจัดหาเงินลงทุนในระบบเกษตรพันธสัญญา ซึ่งจะทำให้เกิดความเป็นธรรมกับเกษตรกรและผู้ประกอบธุรกิจทางการเกษตรอย่างแท้จริง อันจะส่งผลให้ธุรกิจการเกษตรของประเทศไทยสามารถพัฒนาควบคู่ไปกับการพัฒนาคุณภาพชีวิตของเกษตรกรและเป็นการยกระดับอุตสาหกรรมเกษตรไทยให้มีความเข้มแข็ง มั่นคง และมีศักยภาพในการแข่งขันกับประเทศอื่น ๆ ต่อไป
