บทคัดย่อ
การวิจัยนี้มีวัตถุประสงค์ (1) เพื่อศึกษาความหมายความเป็นมาแนวคิดทฤษฎีเกี่ยวกับกฎหมายคุ้มครองผู้บริโภคด้านการซื้อรถยนต์ใหม่ ทั้งของประเทศไทยและของต่างประเทศ (2) เพื่อนำมาเปรียบเทียบและวิเคราะห์ปัญหาการซื้อรถยนต์ใหม่ของผู้บริโภคในประเทศไทย และ (3) เพื่อเสนอแนะแนวทางการแก้ไขปัญหาสำหรับการปรับปรุงและพัฒนากฎหมายคุ้มครองผู้บริโภคสำหรับการรับผิดชอบในความชำรุดบกพร่องของรถยนต์ใหม่ของผู้ประกอบธุรกิจ โดยเป็นงานวิจัยเชิงคุณภาพ ผลการวิจัยพบว่า (1) ปัญหาการซื้อรถยนต์ใหม่ของผู้บริโภคในประเทศไทยเกี่ยวข้องกับกฎหมายหลายฉบับ การพิสูจน์รถยนต์ที่มีความชำรุดบกพร่อง ไม่ว่าจะเป็นรถยนต์ที่ไม่ปลอดภัยหรือไม่ใช้เวลานานทำให้ผู้บริโภคเสียเปรียบ เพราะยังไม่มีกฎหมายใด ๆ เกี่ยวกับการคุ้มครองผู้บริโภคสำหรับรถยนต์ใหม่ (2) ได้เปรียบเทียบกฎหมายและข้อบังคับของประเทศไทยกับบางประเทศ เช่น สหรัฐอเมริกา ญี่ปุ่น และเยอรมนี และ (3) เสนอให้ประเทศไทยควรออกกฎหมายเฉพาะเกี่ยวกับการคุ้มครองผู้บริโภคเพื่อคุ้มครองผู้บริโภคจากการซื้อรถยนต์ใหม่ที่ชำรุดบกพร่อง
