บทคัดย่อ
ในปัจจุบันการทำธุรกรรมประเภท FOREX ได้รับความนิยมเพิ่มขึ้นเป็นอย่างมาก ด้วยเหตุที่ FOREX สามารถทำการซื้อขายได้ตลอด 24 ชั่วโมง และการวิเคราะห์ตลาดง่ายกว่าการซื้อขายหุ้นในตลาดหลักทรัพย์ทำให้มีนักลงทุนสนใจลงทุนในตลาด FOREX มากขึ้น แต่เนื่องจากในประเทศไทยยังไม่มีโบรกเกอร์สำหรับ FOREX โดยเฉพาะ ทำให้ นักลงทุนต้องไปลงทุนกับโบรกเกอร์ในต่างประเทศ เช่นนี้กฎหมายไทยย่อมไม่สามารถที่จะไปบังคับใช้ในต่างประเทศได้ นักลงทุนจึงมีความจำเป็นที่จะต้องแบกรับภาระความเสี่ยงในกรณีที่เกิดความผิดพลาด หรือเกิดจากความทุจริตของโบรกเกอร์เอาไว้เองโดยที่โบรกเกอร์ก็มักจะพยายามยกเว้น หรือจำกัดความรับผิดของตนอีกด้วย ดังนั้น บทความนี้จึงมุ่งศึกษาปัญหาการจดทะเบียนรับรองโบรกเกอร์ FOREX การกำหนดหน้าที่ให้กับโบรกเกอร์ ตลอดจนความรับผิดของโบรกเกอร์ โดยวิเคราะห์ระบบที่เหมาะสมในการจัดตั้งและจดทะเบียนรับรองโบรกเกอร์ FOREX และหน่วยงานที่ทำหน้าที่ควบคุมดูแลโบรกเกอร์ FOREX ตลอดจนวิเคราะห์ว่าควรแก้ไขหรือร่างกฎหมายไทยอย่างไรเพื่อให้สามารถครอบคลุมถึงการกระทำที่กระทบต่อนักลงทุนในตลาด FOREX ทั้งนี้ จะทำการวิเคราะห์เปรียบเทียบกฎหมายของประเทศไทยกับกฎหมายต่างประเทศ ได้แก่ ประเทศสหรัฐอเมริกา ประเทศอังกฤษ และประเทศญี่ปุ่น เพื่อหาแนวทางในการร่างกฎหมายเกี่ยวกับการทำธุรกรรม FOREX ในประเทศไทย
