บทคัดย่อ
บทความวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาแนวทางการจัดการปัญหาการพิสูจน์สถานะและสิทธิของบุคคลตามกฎหมาย เขตตำบลร่องเคาะ อำเภอวังเหนือ จังหวัดลำปาง เป็นการวิจัยเชิงคุณภาพ เครื่องมือที่ใช้ในการเก็บรวบรวมข้อมูล ได้แก่ แบบสอบถามปลายเปิดและแบบสัมภาษณ์เจ้าหน้าที่รัฐ ดำเนินการวิเคราะห์ข้อมูลโดยใช้เทคนิคการวิเคราะห์เชิงเนื้อหา ผลการวิจัยพบว่า มีผู้ให้ข้อมูลทั้งสิ้นจำนวน 97 ราย ในจำนวนนี้เป็นกลุ่มบุคคลที่ได้รับสัญชาติไทยแล้วจำนวน 7 ราย เป็น กลุ่มบุคคลที่มีเฉพาะสถานะทางทะเบียน แต่ยังไม่ได้รับการรับรองสัญชาติไทยจำนวน 12 ราย และมีกลุ่มบุคคลที่ไม่มีทั้งสถานะทางทะเบียน และยังไม่ได้รับการรับรองสัญชาติไทย จำนวน 78 ราย โดยพบปัญหาที่เกี่ยวข้องกับการพิสูจน์สถานะและสิทธิของบุคคลตามกฎหมายหลายประการ กล่าวคือ ปัญหาด้านพยานหลักฐานในการพิสูจน์การเกิดที่ผู้ยื่นคำขอไม่อาจนำมาแสดงต่อเจ้าหน้าที่ของรัฐได้ ปัญหาด้านการสื่อสาร ต่างภาษาระหว่างผู้ยื่นคำขอกับเจ้าหน้าที่รัฐก่อให้เกิดการสื่อสารผิดพลาด ปัญหาด้านองค์ความรู้เกี่ยวกับสิทธิในสัญชาติไทยของผู้ยื่นคำขอ ปัญหาด้านบทบัญญัติของกฎหมายที่ให้อำนาจนายอำเภอหรือผู้ว่าราชการจังหวัดแล้วแต่กรณีเป็นผู้อนุมัติคำขอ และปัญหาด้านเจ้าหน้าที่ในหน่วยงานของรัฐที่มีการปรับเปลี่ยนหรือโยกย้ายตำแหน่งบ่อยครั้งรวมถึงความเกรงกลัวต่อความผิดพลาดที่จะเกิดขึ้น
