Importance of Enactment Law of the Establishment of Vocational Education Institutions of Local Administrative Organization

Abstract

This academic article aims to present the powers and duties of local administrative organizations in the management of vocational education to be consistent with the national education laws. Whereas the National Education Act, B.E. 2542, Section 41 stipulates the local administrative organizations have right to provide education at any level according to their readiness, suitability, and demand for their local area. Moreover, Section 36 stipulates that the public educational institutions which provide degree education must be juristic person, or government agency, and such educational institutions must be under the supervision of their own council in accordance with law of education establishment. At present, the local administrative organizations provide the Vocational Certificate, Diploma/High Vocational Certificate and have potential for up to the Degree level. However, due to the lack of primary law supporting the establishment and juristic person status, be the cause of incompetence in establishing the vocational Education institutions on the degree level. Therefore, it is necessary to enact the Act of The Establishment of Vocational Education Institutions of Local Administrative Organization to be the model law for supporting the establishment of vocational Education institutions of the local administrative organization.
