ในช่วงหลายปีที่ผ่านมา ทั่วโลกกำลังจับตาเฝ้ารอคอยผลการตัดสินกรณีประวัติศาสตร์นโยบายสาธารณสุขซองบุหรี่แบบเรียบง่ายของออสเตรเลียโดยคณะอนุญาโตตุลาการระหว่างประเทศภายใต้กลไกระงับข้อพิพาทระหว่างประเทศ ISDS อย่างใจจดจ่อ เสียงสะท้อนของกลุ่มผู้เคลื่อนไหวเกี่ยวกับปัญหาสุขภาพและการดำเนินนโยบายสาธารณะ ได้รับความสนใจมากยิ่งขึ้นไปด้วย หลายประเทศเตรียมการในการออกกฎหมายเกี่ยวกับนโยบายสาธารณสุขซองบุหรี่แบบเรียบง่าย หลายองค์กรรณรงค์สร้างความตระหนักรู้ถึงปัญหาสุขภาพนโยบายสาธารณะที่ถูกคุกคามภายใต้พันธะกรณีตามกฎหมายระหว่างประเทศภายใต้กลไกการระงับข้อพิพาท ที่นำไปสู่ความสูญเสียที่ใช้ระยะเวลายาวนาน และเงินมูลค่ามหาศาล
เมื่อเดือนธันวาคม พ.ศ. 2558 ผลคำชี้ขาดออกมาแล้วว่าประเทศออสเตรเลียมีชัยชนะ เหนือบริษัทบุหรี่ข้ามชาติ Phillip Morris จริงอยู่ที่ชัยชนะในครั้งนี้ทำให้ประเทศออสเตรเลีย องค์กรภายในประเทศและระหว่างประเทศที่คอยสนับสนุนอยู่ยินดีเป็นอย่างยิ่ง แต่ผลกระทบของคำชี้ขาดที่มิได้ลงลึกไปถึงสารัตถะแห่งความชอบธรรมของนโยบายซองบุหรี่แบบเรียบง่ายของประเทศออสเตรเลียนั้น ทำให้เกิดความคลางแคลงใจและความไม่แน่ชัดในอนาคตอยู่มิใช่น้อย อย่างไรก็ตาม สิ่งสำคัญของบทความนี้คือ การนำเสนอข้อเท็จจริง การทำความเข้าใจกับบริบทเกี่ยวกับการค้าระหว่างประเทศ เรียนรู้กลไกอนุญาโตตุลาการระหว่างประเทศข้อดีข้อเสีย และวิเคราะห์ผลกระทบจากคำชี้ขาดนี้ เป็นบทเรียนที่มีค่าจากออสเตรเลียสู่ไทยเพื่อการเตรียมพร้อมกับความท้าทายที่อาจจะเกิดขึ้นในอนาคต
