บทคัดย่อ
อนุสัญญาสหประชาชาติว่าด้วยข้อตกลงเพื่อระงับข้อพิพาทระหว่างประเทศด้วยการไกล่เกลี่ย (อนุสัญญาสิงคโปร์) ได้กำหนดมาตรฐานในการบังคับข้อตกลงเพื่อระงับข้อพิพาทระหว่างประเทศด้วยการไกล่เกลี่ยขึ้น โดยมีหลักสำคัญ คือ กำหนดเกี่ยวกับเอกสารที่คู่กรณีซึ่งร้องจะต้องยื่นเพื่อดำเนินการขอบังคับและเหตุในการปฏิเสธการบังคับตามข้อตกลงเพื่อระงับข้อพิพาทที่มีอยู่อย่างจำกัด ในส่วนของประเทศไทย ซึ่งเข้าร่วมเป็นภาคีในพิธีสารและอนุสัญญาเกี่ยวกับการระงับข้อพิพาททางเลือกสำหรับข้อพิพาททางพาณิชย์มาโดยตลอดกลับไม่มีท่าทีจะเข้าร่วมเป็นภาคีของอนุสัญญาสิงคโปร์ ทั้งที่อนุสัญญาสิงคโปร์มีวัตถุประสงค์และสาระสำคัญคล้ายคลึงกับอนุสัญญาว่าด้วยการยอมรับและบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ (อนุสัญญานิวยอร์ก) ที่ประเทศไทยเป็นภาคีอยู่ และการเข้าร่วมเป็นภาคีในอนุสัญญาสิงคโปร์จะช่วยสร้างความเชื่อมั่นให้กับนักธุรกิจและนักลงทุนต่างชาติ ซึ่งน่าจะส่งผลดีต่อเศรษฐกิจภาพรวมของประเทศด้วย
