กฎหมายสุขภาพระหว่างประเทศ: มิติใหม่ในการวิจัยด้านสาธารณสุข

กฎหมายสุขภาพระหว่างประเทศเป็นสาขาวิชาที่เกิดมาใหม่ในฐานะสาขาวิชาเล็ก ๆ ในกฎหมายระหว่างประเทศ รัฐเป็นตัวแสดงหลักที่ดำเนินการใช้กฎหมายดังกล่าวและองค์การอนามัยโลกทำหน้าที่หนุนเสริมการบังคับใช้กฎหมายดังกล่าวเสนอมานับตั้งแต่เกิดองค์การอนามัยโลกขึ้น ทั้งนี้ เอกสารทางกฎหมายระหว่างประเทศว่าด้วยสุขภาพมีอยู่อย่างจำกัด เนื่องจากความไม่เชี่ยวชาญของนักกฎหมายที่ต้องการความเชี่ยวชาญทางด้านการแพทย์ วิทยาศาสตร์สุขภาพและการสาธารณสุข เพื่อมาอธิบายและทำความเข้าใจร่วมกัน พร้อมทั้งออกกฎเกณฑ์ให้เป็นมาตรฐานสากลเพื่อบังคับใช้ในระดับโลก
การเกิดการระบาดครั้งใหญ่ของเชื้อโคโรนาไวรัส 2019 ได้ตั้งและตอบคำถามต่อกฎหมายสุขภาพระหว่างประเทศว่าสถานะของกฎหมายสุขภาพระหว่างประเทศมีฐานะเป็นกฎหมายที่มีค่าบังคับใช้อย่างอ่อน จะสามารถบังคับรัฐให้ปฏิบัติตามนั้นเป็นไปได้ค่อนข้างยาก การแพร่ระบาดครั้งสำคัญนี้ส่งผลต่อการตกผลึกในการบังคับใช้กฎหมายสุขภาพระหว่างประเทศ ไม่เพียงแต่เอกสารทางกฎหมายระหว่างประเทศ แต่รวมถึงการประกาศขององค์การอนามัยโลก คู่มือในการปฏิบัติการ การสื่อสารในช่องทางต่าง ๆ ขององค์การอนามัยโลก ทุกรัฐต่างตื่นตัวและปรับตัวเพื่อการปฏิบัติตามอย่างรวดเร็ว เพื่อลดสภาวะความตึงเครียดของพลเมืองโลกเนื่องจากการระบาดของโคโรนาไวรัส 2019
บทบาทสำคัญขององค์การอนามัยโลกทำหน้าที่สื่อสารองค์ความรู้ทางด้านวิทยาศาสตร์สุขภาพ และการสาธารณสุขที่มีอำนาจตัดสินใจต่อการปฏิบัติของรัฐในห้วงเวลาของการระบาดสูงมากขึ้น บทบาทของผู้เชี่ยวชาญในเรื่องกฎหมายสุขภาพระหว่างประเทศและธรรมาภิบาลสุขภาพมีสูงขึ้นตามไปด้วย แต่การตรวจสอบติดตามและการมีส่วนร่วมในการตัดสินใจที่ค่อนข้างเร่งด่วน อันส่งผลกระทบต่อรัฐต่าง ๆ เป็นอย่างมากยังขาดการประเมินและการติดตามอย่างแข็งขัน
บทความชิ้นนี้ เขียนขึ้นเพื่อรองรับการสร้างสนธิสัญญาฉบับใหม่ในการป้องกันการระบาดในอนาคตว่าควรมีปัจจัยใดบ้างที่เข้ามามาส่วนในการจัดการปัญหาในระดับโลก เพื่อให้คลี่คลายไปได้อย่างรวดเร็ว พร้อมทั้ง มาตรการต่าง ๆ ที่ควรได้รับการพิจารณาเข้ามาเป็นส่วนหนึ่งของสนธิสัญญาว่าด้วยการป้องกันการระบาดในอนาคต ทั้งนี้ สถานการณ์ฉุกเฉินในด้านสุขภาพที่มีผลกระทบต่อพลเมืองโลกทั้งหมดอันเกิดขึ้นด้วยความถี่ที่สูงมาก และในขณะเดียวกันมีความจำเป็นเป็นอย่างยิ่งที่นักกฎหมายระหว่างประเทศควรต้องได้รับความร่วมมือจากผู้เชี่ยวชาญทางด้านสุขภาพ เพื่อสร้างมาตรการที่เหมาะสมสำหรับรัฐทุกรัฐ เพื่อป้องกันการระบาดและการมีส่วนร่วมของพลเมืองโลก เพื่อให้การจัดการโรคระบาดอันจะเกิดขึ้นในอนาคตอย่างมีประสิทธิภาพมากยิ่งขึ้น
