การค้าบุหรี่เถื่อนและบุหรี่ไฟฟ้าในประเทศไทยเป็นปัญหาที่มีผลกระทบทั้งด้านสุขภาพและเศรษฐกิจ การเข้าร่วมลงนามและการปฏิบัติตามพิธีสารว่าด้วยการค้าผิดกฎหมายในผลิตภัณฑ์ยาสูบจะช่วยลดการค้ายาสูบผิดกฎหมายและบุหรี่ไฟฟ้าได้ การบังคับใช้กฎหมายที่เข้มงวดและการร่วมมือระหว่างประเทศในการควบคุมการผลิตและการจำหน่ายบุหรี่ไฟฟ้าที่ผิดกฎหมาย พิธีสารฯ นี้เป็นส่วนหนึ่งของกรอบอนุสัญญาการควบคุมยาสูบขององค์การอนามัยโลกมีวัตถุประสงค์ในการปราบปรามการค้าบุหรี่เถื่อนทั่วโลก แม้ว่าพิธีสารนี้จะเริ่มจากการควบคุมบุหรี่ธรรมดา แต่เนื่องจากบุหรี่ไฟฟ้าและผลิตภัณฑ์ยาสูบรูปแบบใหม่ๆ กำลังเป็นที่นิยมขึ้นเรื่อยๆ จึงทำให้พิธีสารนี้มีความสำคัญในการควบคุมการค้ายาสูบผิดกฎหมายทุกรูปแบบ รวมถึงบุหรี่ไฟฟ้าและของเหลวที่ใช้ในบุหรี่ไฟฟ้าที่ผิดกฎหมาย
