ปัญหากฎหมายและความรับผิดทางแพ่งอันเกิดจากการทำงานของหุ่นยนต์ผ่าตัดและระบบปัญญาประดิษฐ์ทางการแพทย์

การศึกษาวิจัยนี้มีวัตถุประสงค์เพื่อมุ่งเน้นไปที่การสร้างองค์ความรู้และวางรากฐานทางกฎหมายสำหรับการใช้เทคโนโลยีสมัยใหม่ โดยเริ่มจากการศึกษาองค์ความรู้และหลักการพื้นฐานเกี่ยวกับหุ่นยนต์ผ่าตัดทางการแพทย์ เพื่อให้เข้าใจถึงกลไกการทำงานและขอบเขตการใช้งานในเชิงลึก จากนั้นจึงนำไปสู่การวิเคราะห์และเปรียบเทียบมาตรการทางกฎหมายของประเทศไทยกับต่างประเทศ เพื่อสำรวจความแตกต่าง จุดแข็ง และข้อจำกัดของข้อบังคับที่มีอยู่ในปัจจุบันและท้ายที่สุด การวิจัยนี้มีเป้าหมายสำคัญในการเสนอแนะมาตรการทางกฎหมายที่เหมาะสมและเป็นรูปธรรม เพื่อยกระดับมาตรฐานความปลอดภัยและสร้างความเชื่อมั่นให้แก่ประชาชนโดยใช้วิธีการศึกษาวิจัยแบบเอกสารที่เกี่ยวข้อง
ผลการศึกษาพบว่า ในเชิงเปรียบเทียบ แม้ต่างประเทศจะเริ่มนำทฤษฎีความรับผิดโดยตรงของสถานพยาบาลมาใช้ เช่น หลักการตรวจสอบวิทยฐานะแพทย์ ในประเด็นความประมาทเลินเล่อในการตรวจสอบและรับรองคุณสมบัติ (ของแพทย์/บุคลากรทางการแพทย์) แต่กฎหมายไทยยังคงจำกัดอยู่ที่ความรับผิดแทนในฐานะนายจ้างตามมาตรา 425 และพระราชบัญญัติความรับผิดต่อความเสียหายที่เกิดขึ้นจากสินค้าที่ไม่ปลอดภัย พ.ศ. 2551 แต่กฎหมายไทยยังคงจำกัดอยู่ที่ความรับผิดแทนในฐานะนายจ้างตามมาตรา 425 และพระราชบัญญัติความรับผิดต่อความเสียหายที่เกิดขึ้นจากสินค้าที่ไม่ปลอดภัย พ.ศ. 2551 ซึ่งบทบัญญัติของกฎหมายดังกล่าวนั้นยังขาดประสิทธิภาพในการการคุ้มครองผู้บริโภคเมื่อเผชิญกับนวัตกรรมที่มีความซับซ้อนสูงและความก้าวหน้าทางวิทยาศาสตร์ (State of the Art Defense) ผู้วิจัยจึงเสนอแนะแนวทางเชิงบูรณาการผ่านการตรากฎหมายหรือระเบียบเฉพาะเพื่อวาง มาตรฐานการปฏิบัติงาน (Standard Operating Procedures) และเกณฑ์การฝึกอบรมที่ชัดเจน พร้อมทั้งขยายขอบเขตความรับผิดเชิงองค์กรของสถานพยาบาลให้ครอบคลุมการกำกับดูแลมาตรฐานเทคโนโลยี นอกจากนี้ ควรปรับปรุงกฎหมายความรับผิดต่อสินค้าให้ครอบคลุมถึงซอฟต์แวร์ทางการแพทย์ และนำระบบชดเชยความเสียหายโดยไม่พิสูจน์ความผิด (No-fault Liability) ร่วมกับระบบประกันภัยความรับผิดทางวิชาชีพมาใช้ เพื่อสร้างสมดุลระหว่างการส่งเสริมนวัตกรรมทางการแพทย์และการคุ้มครองสิทธิของผู้รับบริการอย่างเป็นธรรมและยั่งยืน
