ภาษีความหวานกับนโยบายสาธารณสุขไทย: การวิเคราะห์เชิงกฎหมายและนโยบาย

ปัญหาโรคไม่ติดต่อเรื้อรัง (Non-Communicable Diseases: NCDs) ที่สัมพันธ์กับการบริโภคเครื่องดื่มที่มีน้ำตาลสูง ส่งผลให้หลายประเทศนำมาตรการภาษีสรรพสามิตมาใช้เป็นเครื่องมือทางกฎหมายเพื่อส่งเสริมสุขภาพของประชาชน โดยประเทศไทยได้จัดเก็บภาษีความหวานภายใต้พระราชบัญญัติภาษีสรรพสามิต พ.ศ.2560 ในรูปแบบอัตราภาษีตามปริมาณน้ำตาลแบบขั้นบันได บทความวิจัยนี้มีวัตถุประสงค์เพื่อวิเคราะห์โครงสร้างและข้อจำกัดของมาตรการภาษีสรรพสามิตสำหรับเครื่องดื่มที่มีน้ำตาลของประเทศไทย ศึกษาเปรียบเทียบมาตรการทางกฎหมายของต่างประเทศ และเสนอแนวทางพัฒนากฎหมายและนโยบายภาษีเพื่อสุขภาพที่เหมาะสมกับบริบทของประเทศไทย โดยใช้การวิจัยเชิงคุณภาพผ่านการวิเคราะห์เอกสารทางกฎหมาย งานวิจัย และฐานข้อมูลวิชาการทั้งในประเทศและต่างประเทศ
ผลการศึกษาพบว่า มาตรการจัดเก็บภาษีสรรพสามิตเครื่องดื่มที่มีน้ำตาลของ ประเทศไทยมีส่วนช่วยกระตุ้นให้ผู้ประกอบการปรับสูตรผลิตภัณฑ์และลดการบริโภคเครื่องดื่มที่มีน้ำตาลได้ในระดับหนึ่ง อย่างไรก็ตาม ข้อจำกัดสำคัญมิได้อยู่ที่ระดับอัตราภาษีเพียงอย่างเดียว หากแต่อยู่ที่การขาดการบูรณาการระหว่างมาตรด้านภาษี มาตรการด้านสาธารณสุข มาตรการด้านข้อมูล การควบคุมการตลาด และระบบติดตามประเมินผล ซึ่งส่งผลให้การจัดเก็บภาษีความหวานยังคงทำหน้าที่เป็นเพียงเครื่องมือทางการคลังมากกว่าจะเป็นกลไกกำกับดูแลเพื่อสุขภาพอย่างแท้จริง
ข้อเสนอแนะการวิจัยนี้ ผู้เขียนขอเสนอให้ประเทศไทยควรพัฒนาระบบการจัดเก็บภาษีความหวานให้เป็นกรอบการกำกับดูแลที่มุ่งเน้นสุขภาพ โดยบูรณาการมาตรการภาษีกับกฎหมายด้านอาหาร การคุ้มครองผู้บริโภค และการจัดการปัจจัยกำหนดสุขภาพเชิงพาณิชย์ เพื่อเพิ่มประสิทธิผลในการลดโรคไม่ติดต่อเรื้อรังและสร้างความยั่งยืนของนโยบายภาษีเพื่อสุขภาพในระยะยาว
