People’s Right to Health Care According to the 2017 Constitution under the COVID-19 pandemic

Abstract

          The Constitution is a supreme law of the country. According to the 2017 Constitution, section 47 of chapter 3 specifies the right of Thai people to health care delivered by the state; and section 55 of chapter five specifies the state’s duties to taking care of the public health. Under the condition of COVID-19 pandemic at present, Thailand is under severe crises of public utilities, public health, economic downturn, unemployment, and social problems.It can be seen that thehealth care performance of the state is not successful comparing with the state’s role specified in the Constitution, because the systems of disease prevention and treatment provided by the state are seriously defective, especially, the problem of people’s access to vaccineslately, incoherently, unequally and inefficiently.
