บทคัดย่อ

ตามหลักอาชญาวิทยาเห็นว่า การกระทำผิดต้องเป็นการกระทำที่มีผลกระทบต่อสังคมหรือคนส่วนใหญ่ของประเทศ สาเหตุ
ของการกระทำผิดมักเกิดจากสาเหตุหลายประการผสมกัน เช่น สิ่งแวดล้อมทางเศรษฐกิจและสังคม ความบกพร่องทางรางกายและ
จิตใจ เป็นต้น แนวคิดการแก้ไขผู้กระทำผิดได้พัฒนาจากแนวความคิดเดิมคือ “การแก้แค้นเพื่อทดแทนให้เข็ดหลาบ” มาเป็น “การ
อบรมแก้ไขให้กลับตัวเป็นคนดี” ในทางพระพุทธศาสนามีทัศนะว่า การกระทำผิดเป็นผลมาจากโลภะ โทสะและโมหะ ที่ชักนำจิตใจ
ไปสู่การกระทำทางกาย การแก้ไขจึงต้องแก้ที่ใจให้เป็นสัมมาทิฏฐิ งานวิจัยนี้ได้เสนอแนวทางแก้ไขผู้ที่กระทำผิดโดยประยุกต์จากพระ
วินัย คือ การประพฤติวุฏฐานวิธีและการปลงอาบัติ ที่อาศัยหลักธรรมหลักคือ อริยสัจ 4 และไตรสิกขา 3 มาเป็นเครื่องมือในการ
แก้ไขผู้กระทำผิด ซึ่งทั้ง 2 แนวทางต้องภายใต้เงื่อนไข 3 ประการ ได้แก่ 1) เงื่อนไขกระบวนการ 2) เงื่อนไขคุณธรรม และ 3) เงื่อนไข
ความสำเร็จ

The results revealed that the perpetrators must be dealt with social impact, or the majority of the
country. The causes of crime are caused by a combination of reasons viz., social and economic, physical
and mental disabilities etc. The concept of correction has developed from the original idea of ‘revenge of
the replacement’ to ‘training and correcting to a well returned’.
According to Buddhism, the wrongdoings are rooted from defilements viz., Lobha: greed, Dosa:
hatred and Moha: delusion that induced psychological and physical impact on the offense. The correction
must begin to adjust or fix the right views, then the process of correction. This research aims to solve the
offenders by the application of the Vinaya - Buddhist Discipline, that is to say, vuhāna : the emergence;
forgiveness of an offense, āpattidesanā: the confession of an offense. In addition, the application of the
Buddhist Doctrines from the Discourses (Sutta) viz., the Four Noble Truths and the Threefold of Training.
The two approaches required 3 conditions as: 1) process, 2) morality and 3) accomplishment
