Abstract

Environmental problems are becoming more and more violent. Solving environmental problems and resolving disputes with the judicial process by establishing an environmental court in the form of a special court for environmental judicial should be considered. This research aimed to study: 1) environmental problems, related laws, judicial process, environmental cases, and the establishment of Phuket environmental court; 2) environmental problems, related laws, judicial process and environmental lawsuits which affect the establishment of Phuket environmental court. The sample in quantitative research was a person who was involved in environmental litigation in court involving 300 people in Phuket. Using the stratified sampling method was used according to the proportion of personnel involved in environmental litigation. The sample size used 20 times the observed variable. Data were collected with questionnaires and analysis used the structural equation model. Qualitative research used selective select in-depth interviews from 10 experts from agencies involved in environmental judicial problems. Data analysis was conducted by content analysis. The results were as follows: 1) persons involved in environmental litigation in court agree with environmental issues, laws related to the judicial process, environmental case, and the establishment of Phuket environmental court at a high to the highest level; 2) the structural equation model found that the establishment of an environmental court depended on environmental problems, related laws, judicial process, and environmental lawsuits. Environmental cases depended on environmental problems, related laws, and the judicial process. The judicial process depended on environmental problems and related laws. Therefore, setting up an environmental court would make the judgment of the environmental case in the environmental court to be accurate, fair, effective, and beneficial to people.
