The Age of Consent in the Criminal Law of Thailand

A person has sexual freedom at which giving consent or refuse their sexual activity or sexual relationship. Sexual activities carried out another person must receive a consent. The criminal law protects sexual freedom's person from any sexual activities based on other physical of person. Also, they define any actions take on sexual freedom is a crime. Rape is a type of sexual offense involving sexual intercourse or other forms of sexual penetration carried out against a person without that a person’s consent; thus, the sufferer’s consent is a part of the element of rape offense like the sexual harassment. Legally sexual consent should come from who has a capability of consenting and freedom of decision. The sexual activities carry on their consent aren’t the crime. The legal protection in child sexual activity in the legal age range is child sex offenses. The child’s sexual consent isn’t a part of the element of these offenses. The statutory rape is the legal protection refer to sex between an adult or a minor below the age of consent and receives her consent or not, is a crime. To help protect younger children the law says anyone under the age of consent can never legally give consent. These children are presumed incapable of giving sexual consent. The consent of a younger person or mistake about their age is not a defense. The age of consent is the minimum age which a person is deemed legally competent to consent to sexual activity. A person who has the age of consent can give an agreement to having sexual activity, especially to sexual intercourse. As a result, if someone older engages in sexual acts with a minor under the age of consent, then this activity may be statutory rape. Most jurisdictions allow adolescences can give legally sexual consents. The overwhelming majority of countries have established the minimum age for sexual consent between 15 and 18 years. This article takes into the age of consent in Thailand.
