Abstract

ประเทศไทยเป็นประเทศภาคีของอนุสัญญาระหว่างประเทศว่าด้วยสิทธิเด็กซึ่งมีผลใช้บังคับกับประเทศไทยเมื่อวันที่ 26 เมษายน ค.ศ.1992 และยังตั้งข้อสงวนข้อบท 22 อันเกี่ยวกับการคุ้มครองเด็กผู้ลี้ภัยและเด็กผู้แสวงหาที่พักพิง แม้ว่ากระบวนการถอนข้อสงวนจะยังไม่ได้ดำเนินการจนแล้วเสร็จแต่ทว่าประเทศไทยก็มีหน้าที่ตามหลักการห้ามเลือกปฏิบัติที่จะต้องคุ้มครองเด็กที่เป็นผู้ลี้ภัยหรือผู้แสวงหาที่ลี้ภัยซึ่งปรากฏตัวอยู่ในอาณาเขตของรัฐไทยโดยไม่น้อยไปกว่าเด็กกลุ่มอื่น ๆ ประกอบกับ
บริบทข้อเท็จจริงของการหนีจากประเทศต้นทางเนื่องจากความกลัวอันมีเหตุผลจากภัยประหัตประหารสะท้อนว่าเด็กกลุ่มนี้อยู่ในสถานการณ์เฉพาะที่จะต้องได้รับความคุ้มครองตามระดับปัญหาที่พวกเขาเผชิญอยู่ ดังเจตนารมณ์การคุ้มครองเด็กของอนุสัญญา ในเบื้องต้นบทความนี้ยอมรับว่าการถอนข้อสงวนย่อมมีผลดีสำหรับการยืนยันเจตนารมณ์ของประเทศไทยต่อการคุ้มครองผู้ลี้ภัยเด็กและผู้แสวงหาที่พักพิง อย่างไรก็ตามบทความให้ความสำคัญกับการตรวจสอบว่าทำอย่างไรประเทศไทยจึงจะดำเนินการบรรลุต่อหน้าที่ความรับผิดชอบตามกฎหมายต่อผู้ลี้ภัยเด็ก ในการนี้ประเด็นสำคัญอยู่ที่ว่าประเทศไทยจำต้องมีกฎเกณฑ์ของตนตามมาตรฐานระหว่างประเทศในการระบุและจำแนกชัดเจนว่า เด็กคนใดเป็นผู้ลี้ภัยรวมถึงผู้แสวงหาที่พักพิง ขณะที่การคุ้มครองที่เหมาะสมอย่างรอบด้านสำหรับเด็กกลุ่มดังกล่าวต้องอาศัยมาตรการที่เหมาะสมสำหรับประเมินความจำเป็นของเด็กตามหลัก
ประโยชน์สูงสุดของเด็ก นอกจากนั้นบทความยังได้วิเคราะห์ทางออกสำหรับคุ้มครองสิทธิของผู้ลี้ภัยเด็กตามข้อ 22 โดยอาศัยพื้นฐานจากข้อกังวลและข้อเสนอจากคณะกรรมาธิการประจ าอนุสัญญาระหว่างประเทศว่าด้วยสิทธิเด็ก รวมถึงคณะกรรมาธิการอื่นของสหประชาชาติที่มีต่อประเทศไทย
