The Right of People and Community to Sue the State Agency to Comply with Section 51 of the Constitution of the Kingdom of Thailand B.E. 2560 and Section 45 of the Organic Act on Procedures of the Constitutional Court B.E. 2561

The duties of the State are promulgated for the first time in Chapter V of the Constitution of the Kingdom of Thailand B.E. 2560. The State has various tasks to perform and accomplish. If any missions mentioned in Chapter V are inattentive, the relevant state agency will take the legal responsibility. The people and the community shall have the right to follow up and urge the State to perform their duties. They also have the right to sue the state agency responsible to the Constitutional Court, provided by Section 51 of the Constitution of the Kingdom of Thailand B.E. 2560 and Section 45 of the Organic Act on Procedures of the Constitutional Court B.E. 2561. This ensures that the people’s rights and freedoms are really respected.
