แนวทางการพัฒนากฎหมายเพื่อรองรับการจ่ายค่าตอบแทนการให้บริการของระบบนิเวศป่าไม้

การจ่ายค่าตอบแทนการให้บริการของระบบนิเวศเป็นเครื่องมือทางเศรษฐศาสตร์ที่ได้รับความสนใจในการอนุรักษ์ป่าไม้ โดยยึดหลักที่ว่า ผู้รับประโยชน์เป็นผู้จ่าย ซึ่งผู้รับประโยชน์จากนิเวศบริการ หมายถึง บุคคลที่ได้ประโยชน์จากนิเวศบริการไม่ทางใดก็ทางหนึ่ง หรือแม้กระทั่งเป็นบุคคลที่ต้องอาศัยนิเวศบริการเป็นส่วนสำคัญในการดำรงชีวิต คนกลุ่มนี้จึงถูกเรียกร้องให้รับผิดชอบต่อค่าใช้จ่ายหรือค่าเสียโอกาสให้กับผู้จัดหานิเวศบริการที่คอยจัดการหรือทำให้เกิดนิเวศบริการขึ้น สำหรับประเทศไทย มีการกล่าวถึงเครื่องมือนี้ในแผนพัฒนาเศรษฐกิจและสังคมแห่งชาติฉบับที่ 11 และนโยบายและแผนการส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. 2560-2580 อย่างไรก็ดี ในระดับกฎหมายยังไม่มีการรองรับไว้แต่อย่างใด บทความนี้มุ่งศึกษาแนวคิดและองค์ประกอบที่สำคัญ มีการถอดบทเรียนของคอสตาริกา เม็กซิโกและเวียดนาม และเสนอกรอบการพัฒนากฎหมายไทยเพื่อรองรับการจ่ายค่าตอบแทนการให้บริการของระบบนิเวศป่าไม้สำหรับประเทศไทย
