The Legal Approaches to Drug Abuse Treatment and Rehabilitation in Thailand: Case of drug-related offences

This article addresses the legal approach to drug abuse treatment and rehabilitation in Thailand in the case of drug-related offences. The author maintains that referring people with drug use disorders to treatment at an early stage of the criminal justice system, considering differences among individuals, leads to a much greater likelihood of effective treatment and rehabilitation. The main proposed legal amendments are to modify Narcotic Drugs Code Section 114, which concerns alleged offenders who are entitled to rehabilitation plans, to include those who have committed low- level drug-related crimes. In this regard, voluntary drug users who commit nonviolent drug-related offences shall be diverted to health-care service agencies if a memorandum of agreement between an alleged offender and an injured person is completed according to Dispute Mediation Act B.E. 2562, or public prosecutors grant suspension of prosecution in the case of public- order offences.
