บทคัดย่อ
บทความนี้มีวัตถุประสงค์เพื่อศึกษาความเป็นมา แนวคิดที่เกี่ยวข้องกับการอุทิศที่ดินให้เป็นสาธารณสมบัติของแผ่นดิน ศึกษาหลักเกณฑ์การอุทิศที่ดินให้เป็นสาธารณสมบัติของแผ่นดินตามกฎหมายไทยและกฎหมายต่างประเทศ เพื่อวิเคราะห์ปัญหาเกี่ยวกับการอุทิศที่ดินให้เป็นสาธารณสมบัติของแผ่นดินตามกฎหมายไทยและกฎหมายต่างประเทศ และเพื่อเสนอแนะการปรับปรุงกฎหมายเกี่ยวกับการอุทิศที่ดินให้เป็นสาธารณสมบัติของแผ่นดินให้เหมาะสมกับบริบทของสังคมไทย เป็นการวิจัยเชิงคุณภาพ โดยใช้วิธีการวิจัยเชิงเอกสาร ศึกษาความเป็นมาและการเป็นสาธารณสมบัติของแผ่นดิน ปัญหาการอุทิศที่ดินโดยชัดแจ้ง และปัญหาการอุทิศที่ดินโดยปริยาย จากการศึกษาพบว่า กฎหมายที่เกี่ยวกับการอุทิศที่ดินไม่ปรากฏบทบัญญัติเฉพาะ ไม่ปรากฏรายละเอียดการอุทิศที่ดินของเอกชนที่มิต้องทำเป็นหนังสือและจดทะเบียนต่อพนักงานเจ้าหน้าที่ การตั้งใจให้ประชาชนทั่วไปได้ใช้ประโยชน์ในที่ดิน หรือปล่อยให้ประชาชนทั่วไปได้ใช้ประโยชน์ในที่ดินของตนเองโดยมิได้ห้ามปราม หรือสงวนสิทธิ ตั้งแต่ 10 ปีเป็นต้นไป จะทำให้ที่ดินของเอกชนตกเป็นสาธารณสมบัติของแผ่นดินหรือตกเป็นของรัฐได้ บทความนี้จึงเสนอแนวทางการปรับปรุงกฎหมาย โดยนำกฎหมายของประเทศออสเตรเลีย และกฎหมายของรัฐหลุยเซียน่า ประเทศสหรัฐอเมริกา มาปรับใช้เพื่อให้เกิดความชัดเจนในการอุทิศที่ดินให้เป็นสาธารณสมบัติของแผ่นดิน
