ภูมิสถาปัตย์ทางกฎหมายของสัญญาจ้างนักกีฬาอาชีพในระบบกฎหมายไทย อังกฤษ เยอรมนี สเปน และอิตาลี

บทคัดย่อ
บทความนี้เป็นผลจากการวิจัย เรื่อง ภูมิสถาปัตย์ทางกฎหมายหรือกรอบกฎหมายของสัญญาจ้างนักกีฬาอาชีพในระบบกฎหมายของประเทศไทย อังกฤษ เยอรมนี สเปน และอิตาลี มีวัตถุประสงค์สามประการ คือ 1. เพื่อศึกษาสภาพและปัญหากฎหมายสัญญาจ้างนักกีฬาอาชีพของประเทศไทย 2. เพื่อศึกษาเปรียบเทียบกฎหมายสัญญาจ้างนักกีฬาอาชีพของประเทศเยอรมนี อังกฤษ สเปน อิตาลี และไทย และ 3. เพื่อนำเสนอแนวทางการปรับปรุงพัฒนากฎหมายสัญญาจ้างนักกีฬาอาชีพของประเทศไทย โดยใช้วิธีวิจัยเชิงคุณภาพ ด้วยวิธีวิเคราะห์ข้อมูลจากเอกสาร การวิจัยพบว่า ประเทศอังกฤษและเยอรมนี ใช้กฎหมายแรงงานทั่วไปบังคับกับสัญญาจ้างแรงงานนักกีฬาอาชีพ ขณะที่ประเทศสเปน อิตาลี และไทย ใช้กฎหมายเฉพาะ ในประเทศไทยสัญญาจ้างนักกีฬาอาชีพและบุคลากรกีฬาอาชีพ อยู่ภายใต้บังคับแห่งพระราชบัญญัติส่งเสริมกีฬาอาชีพ พ.ศ. 2556 และประกาศคณะกรรมการกีฬาอาชีพ เรื่อง มาตรฐานการจ้างและมาตรการในการคุ้มครอง พ.ศ. 2560 นอกจากนี้ การศึกษายังระบุด้วยว่า นิติสัมพันธ์ทางสัญญาระหว่างนักกีฬาอาชีพที่มีชื่อเสียงกับสโมสรกีฬามีลักษณะเป็นสัญญาทางพาณิชย์ยิ่งกว่าสัญญาจ้างแรงงาน แต่กฎหมายในปัจจุบันยังไม่ครอบคลุมถึงสัญญาทางพาณิชย์ดังกล่าว ทำให้กฎหมายไม่สอดคล้องกับสภาพแวดล้อมที่เปลี่ยนแปลงไป จึงควรแก้ไขปรับปรุงกฎหมายดังกล่าว
