วิเคราะห์ปัญหาเกี่ยวกับที่มาของกฎหมายลายลักษณ์อักษร: กรณีศึกษาประเทศไทย

บทคัดย่อ
บทความวิชาการนี้มีวัตถุประสงค์เพื่อศึกษาปัญหาของสถานะทางกฎหมายของประกาศคณะปฏิวัติ และลำดับชั้นของกฎหมายในประเทศไทย พบว่ามีข้อถกเถียงกันในทางวิชาการในประเด็นของสถานะทางกฎหมายและลำดับชั้นทางกฎหมายหลายประเด็น ได้แก่ 1. ประเด็นสถานะทางกฎหมายของประกาศคณะปฏิวัติถือว่าเป็นกฎหมายที่สมบูรณ์และเป็นที่ยอมรับว่าเป็นเครื่องมืออย่างหนึ่งในการควบคุมสังคม เพราะว่าประกาศคณะปฏิวัติใช้อำนาจตามกฎหมายหลายระดับ ประกอบด้วยการยกเลิก เปลี่ยนแปลง แก้ไข การเพิ่มเติมกฎหมาย หรือการใช้บังคับคู่ขนานกับกฎหมายเดิมที่มีอยู่แล้ว เพื่อให้การบังคับเป็นไปตามเจตนารมณ์ของคณะรัฐประหาร 2. ประเด็นปัญหาทางกฎหมายในระดับชั้นทางกฎหมาย คือ พระราชบัญญัติประกอบรัฐธรรมนูญเป็นกฎหมายที่ออกมาขยายเนื้อหารายละเอียดของรัฐธรรมนูญมีลำดับชั้นทางกฎหมายสูงกว่าหรือเท่าเทียมกับพระราชบัญญัติ รัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 ได้กำหนดวิธีการจัดทำพระราชบัญญัติประกอบรัฐธรรมนูญยากกว่า พระราชบัญญัติ ควรจะมีลำดับชั้นสูงกว่าพระราชบัญญัติ และ 3. ประเด็นปัญหาสถานะทางกฎหมายของพระราชกฤษฎีกาที่ออกโดยอาศัยอำนาจรัฐธรรมนูญจะมีสถานะทางกฎหมายหรือลำดับชั้น เป็น “กฎหมาย” (ระดับกฎหมายบัญญัติ) ได้ ต้องเป็นพระราชกฤษฎีกาที่มีคำวินิจฉัยของศาลรัฐธรรมนูญ เพราะคำวินิจฉัยศาลรัฐธรรมนูญผูกพันทุกองค์กร
