มาตรการทางกฎหมายในการคุ้มครองข้อมูลส่วนบุคคลของเด็กในยุคดิจิทัล: ศึกษาเปรียบเทียบกฎหมายในประเทศไทยกับกฎหมายต่างประเทศ

บทคัดย่อ
การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาปัญหาเกี่ยวกับการคุ้มครองข้อมูลส่วนบุคคลของเด็กบนสื่อออนไลน์ 2) ศึกษาประเด็นมาตรการทางกฎหมายของประเทศไทยที่เกี่ยวกับการคุ้มครองข้อมูลส่วนบุคคลของเด็กบนสื่อสังคมออนไลน์ และเปรียบเทียบกับมาตรการทางกฎหมายของต่างประเทศ และ 3) หาแนวทางแก้ไขปัญหาเกี่ยวกับการคุ้มครองข้อมูลส่วนบุคคลของเด็กในประเทศไทยที่เหมาะสมทางกฎหมายที่เกี่ยวข้องกับการคุ้มครองข้อมูลส่วนบุคคลของเด็กบนสื่อออนไลน์ เป็นการวิจัยเชิงคุณภาพโดยรวบรวมข้อมูลจากหนังสือ บทความ วิทยานิพนธ์ รายงานการวิจัย และเอกสารที่เกี่ยวข้อง ผลการวิจัยพบว่า ปัญหาการคุ้มครองข้อมูลส่วนบุคคลของเด็กบนสื่อออนไลน์ในประเทศไทย ยังขาดบทบัญญัติที่ชัดเจนและครอบคลุม โดยเฉพาะเรื่องนิยาม ขอบเขต การขอความยินยอมจากผู้ปกครอง หน้าที่ของผู้ควบคุมข้อมูล และมาตรการเฉพาะสำหรับสื่อสังคมออนไลน์ อีกทั้งยังมีปัญหา
ในการบังคับใช้และการประสานงานระหว่างหน่วยงาน เมื่อเทียบกับกฎหมายต่างประเทศอย่าง GDPR และ COPPA ที่มีมาตรการเฉพาะและมีประสิทธิภาพมากกว่า แนวทางแก้ไขควรปรับปรุงพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 ให้มีบทบัญญัติเฉพาะเกี่ยวกับข้อมูลเด็ก เช่น ระบบตรวจสอบอายุ การจำกัดการใช้ข้อมูลเพื่อการตลาด และเพิ่มมาตรการลงโทษ รวมทั้งแก้ไขพระราชบัญญัติคุ้มครองเด็ก พ.ศ. 2546 ให้ครอบคลุมบริบทดิจิทัลพร้อมส่งเสริมความรู้ในสถานศึกษาและพัฒนากลไกเยียวยาให้มีประสิทธิภาพ เพื่อยกระดับการคุ้มครองเด็กไทยให้สอดคล้องกับมาตรฐานสากล
