Landholding of Foreigners under the Investment Law : Case Study of the Kingdom of Thailand Compared to Republic of Malaysia

Abstract

             This research paper intends to study the legal measure in land ownership of foreigner under the law that supports investment by investigating on the cases in the Kingdom of Thailand in comparison with Malaysia. As the present society is entering the ASEAN economic community, the ASEAN countries that have come to invest under the ASEAN countries may have equal rights as their own citizens. Thailand is considered a country that foreign investors are interested in, due to the geographical area and the abundance of natural resources that are still plentiful. Therefore, various countries are interested in investing in Thailand. Land investment is another venture that should be focused, as land is an important factor in human survival. Land investment is hence receiving a lot of attention from both internal and foreign investors. The result of such investment brings in at the technology in manufacturing and service  into the country. Most developing countries have several measures to support investment in their own country, including Thailand. As a result, there are legal measures to encourage and attract foreign investors to invest in the country. At the same time, there are measures in regulating the land ownership for investment. There might be an excessive amount of foreigners having land ownership when there is an allowance in permitting foreigners to invest and hold ownership of land. If this problem persists Thailand might face the issues of stability and other related drawbacks might follow.
