The Analyzing of the Draft Act to Elect Local Council Members or Local Administrators (No....) B.E. ... by the New Constitution of B.E. 2560 (2017).

Abstract

This research has been written based on a qualitative research by the theory of public law such as the democracy, the election, and the decentralization. This research focused on analyzing the essence of the bill for the election of local council members or the local executive (No. ...) BE.... (Called “Draft law”) that is consistent with the provisions of the constitution B.E.2560 (2017) and the other laws and provided feedback on key points to develop the draft law. In this research, the researcher divided the draft law into 6 aspects; the aspect of the organization of the local elections, aspect of controlling Local Elections Budget, aspect of local election costs, aspect of the voting place and vote count, an aspect of Local Elections and other aspects for the Integrity of Laws and Elections. The suggestions for this research are to consider reviewing the principles of eligibility for candidates in the second round election, to review the draft law that is too wide that cannot be used practically and to review the  authority  of the Election Commission of Thailand which are not controlled by the level of the command between the governor and the sheriff due to the duplication of authority. Finally, modifying the words and contents of the draft law to be consistent with its definition to prevent the overlap of words and to clarify the use and interpretation of law.
