Legal Measure Relating Law to Gambling: Study Free Opening Casino Industry.

Abstract

                This objective of this research was to study Legal measures on enforcement against the Gambling Act B.E.2478 (1935) (8th amendment): A case study of free Gambling opening patterns in Thailand by considered as problems (1) illegal gambler punishment (2) enforcement against Gambling Act (3)monitoring and permitting gambling (4) gambling laws were not in accordance with the constitution of the kingdom of Thailand B.E.2560 (1997).

                The research result revealed that since the promulgation of the Gambling Act B.E.2478 (1935) and there was an 8th amendment but there was still gambling problems. This was summarized as follows: (1) Penalties under the Gambling Act, 1935 (8th amendment), the maximum penalty was not more than 5,000 and imprisonment was not exceeding 3 years. Obviously, penalty rates and fines for gambling smugglers were too low penalty rate, causing the smuggler was not be afraid of the law (2) Enforcement against gambling was also flawed, not related the economic, social, political, and technological developments for smuggle online gambling. There was a casino website that played via a mobile phone system. There was raising money and payment to the winning gambler can be paid via mobile phone systems.(3)Monitoring and permitting gambling as the Gambling Act B.E.2478 (1935), currently,  politicians and businessmen have proposed it that the government allows the opening of a legal casino in order to increase tax revenue for the government, promote tourism, create jobs for the public. It also helps to reduce the leakage of money that gamblers go to casinos in overseas. However, the law did not open the action channel (4) The Gambling Act B.E. 2478 (8th amendment) was not in accordance the Constitution of the Kingdom of Thailand B.E. 2560 that the state should be provide only the law as necessary or improve the law was not consistent with the current situation
