อาเซียน : กฎหมายที่เกี่ยวข้องกับการอนุรักษ์ ทรัพยากรธรรมชาติและสิ่งแวดล้อม

Abstract

อาเซียนเป็นภูมิภาคที่มีความอุดมสมบูรณ์ของทรัพยากรธรรมชาติอย่างมหาศาลและเป็นแหล่งผลิตอาหารที่สำคัญของโลก อย่างไรก็ตามในปี 2558 ซึ่งมีการเปลี่ยนแปลงครั้งสำคัญในภูมิภาค คือ การเปิดประชาคมอาเซียน (ASEAN Community) ซึ่งจะเป็นทั้งปัจจัยเสี่ยงและความท้าทายของการจัดการทรัพยากรธรรมชาติและสิ่งแวดล้อมของภูมิภาค จึงเป็นสาเหตุที่ควรศึกษากฎหมายสิ่งแวดล้อม (environmental law) ในประเทศอาเซียน เพื่อให้ทราบถึงมาตรการในการดูแลจัดการสิ่งแวดล้อมให้ไปในทิศทางเดียวกัน เร่งให้เกิดการร่วมมือระหว่างประเทศในการบริหารจัดการสิ่งแวดล้อมให้ยั่งยืน รวมไปถึงการศึกษา กฎ ระเบียบและข้อบังคับในระดับประเทศ เพื่อหาจุดต่างและความสอดคล้องให้การพัฒนาเป็นไปทิศทางเดียวกันทั้งโดยทางตรงและโดยทางอ้อม ปัญหาของประเทศไทย เมียนมาร์ และลาวมีการกำกับดูแลด้านสิ่งแวดล้อมที่เข้มงวดน้อยกว่า อาจส่งผลให้เกิดความเสื่อมโทรมของทรัพยากรธรรมชาติและปริมาณมลพิษโดยรวมของภูมิภาคเพิ่มสูงขึ้นในที่สุด การเตรียมความพร้อมในด้านการจัดการ เพื่อป้องกันผลกระทบที่จะเกิดขึ้นและเพื่อให้ทรัพยากรธรรมชาติและสิ่งแวดล้อมภายในประเทศอาเซียน มีความยั่งยืนต่อไปในอนาคต จึงเป็นประเด็นที่ท้าทาย ซึ่งต้องอาศัยความร่วมมือจากทุกภาคส่วนในการพัฒนาความสามารถในการรับมือต่อผลกระทบดังกล่าวASEAN : Natural Resources and Environmental Conservation Laws

ASEAN is one of the most abundance of natural resources and significant food production region. In 2015 the ASEAN community shall be launched together as one community that will enhance the risk of challenge for natural resources and environmental management throughout the region. The significant management tool is law and regulations among ASEAN countries in order to protect and preserve of natural resources and environment in the sustainable aspects. This article tries to study the related law and regulations both direct and indirect in the different and consistent aspects including the effectiveness application of those law and regulations. Thailand, Myanmar and Laos were the weaker countries on law and regulations application compare to others, which will affect their natural resources and environment degradation. The projection on the preparedness of the protection and conservation shall ensure the future sustainable development. The good cooperation among stakeholders would be the significant tool to cope with the specified impacts.
