GUIDELINES FOR COPYRIGHT PROTECTION IN MUSICAL FROM THE NUMBER OF REPEATED SENTENCES AGAINST COPYRIGHT INFRINGEMENT IN THAI COUNTRY SONGS

Abstract

This research paper is due to the problem of setting boundaries for trials arising from the number of repeated sentences in a musical instrument, whether they should be copyright infringement or not, and whether they are protected under copyright law. There is currently no law on such matters.

The purposes of the study were 1) to study the current state of the number of sentences per copyright violation in the music of Thai country songs, 2) to study the factors related to the number of duplicate sentences per copyright violation in the music of Thai country songs. 3) to Study the guidelines used to determine the number of good and appropriate word sentences for the elimination of copyright infringement in the music of Thai country songs. Qualitative information is available to 5 qualified individuals selected specifically. The quantitative information is: 250 singers, musicians, professional writers and staff in Thai country songs, 152 samples using Craigsie and Morgan's data from May 2565 to March 2023, analyzed the data with descriptive statistics such as frequency, percentage, average, standard deviation, and content analysis. Research results showed that

1. Thai country songs Band was established about 40 to 60 years ago. The creation of Thai country songs. music is usually from liking any song and the author uses it as an inspiration. But the old or new lyrics are used so that people cannot remember the old songs or the original.


2. Factors related to the number of duplicates for the elimination of copyright infringement in music under the Copyright Act B.E. 2537, found that 95 men or 62.5 percent, 38 men under the age of 31, 25.0 percent, and 38 women between 36 and 40 years, 25.0 percent.0 education, 76 bachelor's degrees or 50.0% or 114 students or 75.0% of the total number of albums presented to the public, 143 students or 94.0%, the opinion is high.


3. Guidelines used to determine the number of good and appropriate word sentences. Therefore, the Copyright Act B.E. 2537 Section 32 should be amended by adding subsection (9) to add "replication, modification, expression, part of work or cut or make the appearance of sentences, words, rhythm." And repeat music, which is similar in the order of chords and unimportant notes that happen by accident, not by the intention of the creator, with sentences, words, rhythms.
