ว่าด้วยมืออาชีพ : พนักงานสอบสวนกับวิถีการแสวงหาพยานหลักฐานทางนิติวิทยาศาสตร์ คดีจราจร (On professionalism: Police investigators and means of forensic evidence acquisition in road crash investigation)

Abstract

              พนักงานสอบสวนนับว่าเป็นกลุ่มตำรวจที่มีบทบาทสำคัญอย่างมากในการแก้ไขและป้องกันอุบัติเหตุทางถนนที่เป็นปัญหาสำคัญของประเทศอยู่ในขณะนี้ เนื่องจากขั้นตอนการสอบสวนคดีจราจรทำให้ทราบข้อมูลของอุบัติเหตุทางถนนที่มีความละเอียด โดยเฉพาะอย่างยิ่งสาเหตุของการเกิดอุบัติเหตุในระดับพื้นที่และส่งผลให้การวิเคราะห์สาเหตุและแนวทางแก้ไขป้องกัน ในระดับอำเภอ จังหวัดและระดับชาติเป็นไปอย่างมีประสิทธิภาพสูงสุดด้วย เมื่อพิจารณาว่าพนักงานสอบสวนจำเป็นต้องมีสมรรถนะสูงในการแสวงหาพยานหลักฐานทางนิติวิทยาศาสตร์คดีจราจรแล้วนั้น งานวิจัยครั้งนี้จึงตั้งคำถามว่าพนักงานสอบสวนไทยมีความรู้ในการแสวงหาพยานหลักฐานทางนิติวิทยาศาสตร์คดีจราจรเป็นอย่างไร? และได้รับปัจจัยสนับสนุนการสอบสวนคดีจราจรเป็นอย่างไร? วัตถุประสงค์ประกอบด้วย 1. ศึกษาขั้นตอน วิธีการปฏิบัติ และปัจจัยสนับสนุนในการแสวงหาพยานหลักฐานทางนิติวิทยาศาสตร์ของพนักงานสอบสวนคดีจราจร และ 2. ศึกษาความรู้ในการแสวงหาพยานหลักฐานทางนิติวิทยาศาสตร์ในคดีจราจรของพนักงานสอบสวน

            ผู้วิจัยใช้ระเบียบวิธีการวิจัยเชิงคุณภาพโดยการรวบรวมความรู้จากพื้นที่วิจัยในเขตรับผิดชอบของตำรวจภูธรภาค 1 ผู้ให้ข้อมูลหลักคือ พนักงานสอบสวนที่มีประสบการณ์ในการทำคดีจราจรที่มีคนตายจำนวน 60 คน และเจ้าหน้าที่นักวิทยาศาสตร์พิสูจน์หลักฐานจำนวน 7 คน ใช้เทคนิคการเก็บข้อมูลด้วยวิธีการสนทนากลุ่ม การสัมภาษณ์เชิงลึก และการศึกษาค้นคว้าเอกสารสำนวนคดีจราจรจำนวน 262 สำนวน ใช้วิธีการวิเคราะห์ข้อมูลเชิงเนื้อหา

            ผลการวิจัยพบว่า พนักงานสอบสวนไม่สามารถให้นิยามความหมายการทำงานในบริบทของการแสวงหาพยานหลักฐานทางนิติวิทยาศาสตร์ว่ามีความเป็นมืออาชีพได้เนื่องมาเหตุผลสำคัญ 4 ประการ คือ 1) การจำเป็นต้องพึ่งพาการทำงานของผู้เชี่ยวชาญอื่นในการทำงาน 2) การรับรู้ต่อการตั้งคำถามเรื่องความเชื่อถือได้ของบุคคลที่เกี่ยวข้อง 3) การทำงานที่ขาดแคลนปัจจัยสนับสนุนในการทำงาน 4) การได้รับการส่งเสริมพัฒนาความรู้ที่ไม่เป็นระบบและขาดความต่อเนื่อง

            ทั้งนี้ พนักงานสอบสวนมีทัศนะว่าพวกเขาต้องการรับการสนับสนุนอย่างมากในประเด็นที่ 4 ซึ่งการขาดหายไปในด้านการพัฒนาความรู้ที่เป็นระบบและต่อเนื่องนี้ส่งผลกระทบอย่างมากต่อการทำงานแบบมืออาชีพของพนักงานสอบสวนในคดีจราจร

            ข้อเสนอแนะจากงานวิจัยในครั้งนี้คือ การแก้ไขและป้องกันอุบัติเหตุทางถนนรวมถึงการสร้างความยุติธรรมในคดีจราจรให้เป็นผลดีมากกว่าในอดีตที่ผ่านมาเป็นหน้าที่ของผู้บริหารและผู้กำหนดนโยบายในการพัฒนาและส่งเสริมความเป็นมืออาชีพในการแสวงหาพยานหลักฐานทางนิติวิทยาศาสตร์คดีจราจรให้แก่พนักงานสอบสวนเพื่ออำนวยความยุติธรรมแก่คู่กรณีได้มากที่สุด รวมตลอดถึงประโยชน์ในการแก้ไขและป้องกันอุบัติเหตุทางถนน เพื่อลดสถิติคนเจ็บคนตายจากการจราจร

          Police investigators play a key role in preventing and solving road accident cases, which are presently a matter of great concern in Thailand. The complete procedures for traffic accident investigation can provide useful and fully-detailed data, especially the causes of road accidents at the local level. This can in turn facilitate the most efficient analysis of causes and preventions of road accidents in multi-level governance including district, provincial and national levels. As traffic accident investigation requires high competence in forensic evidence collection and analysis from police investigators, the two main research questions were as follows: 1) to what extent do police investigators know how to acquire forensic evidence in road accident?; and 2) how were police investigators supported by police management systems in road crash investigation? The research objectives were to study: 1) the procedure, implementation and supporting factors of forensic evidence acquisition of police investigators; and 2) police investigators’ knowledge of forensic evidence acquisition in road crash investigation

            This research used qualitative research method to collect data from the research area, which was the Provincial Police Region 1. Key informants comprised 60 highly-experienced police investigators involved in the investigation of fatal road accidents and 7 forensic scientists. Data were collected using focus-group discussion, in-depth interview and content analysis of 262 road accident cases.

            Research findings indicated that police investigators could not define professionalism in the context of forensic evidence acquisition due to 4 reasons: 1) dependency on external experts in the investigation, 2) the acknowledgment of skepticisms relatied to the credibility of those who were engaged in the investigation, 3) insufficient support in police work, and 4) the lack of systematic and continued knowledge training provision. Most of the investigators from this research stated that they required support to deal with the fourth reason. The systematic and continued development of knowledge were seriously lacking, which had a considerable influence on professionalism in police investigators.

            Research suggests that to prevent and solve road accidents as well as enhance justice in road accident cases, public administrators and policymakers should be responsible for improving professionalism in forensic evidence acquisition for traffic accidents. This can deliver justice to the relevant parties. In addition, it can solve and prevent road accidents, thereby reducing the rate of fatality and injuries.
